THNK, LLC LIMITED WARRANTY
This consumer warranty extends to the original purchaser of the THNK, LLC product (the “Product”). This is the only express warranty for the Product and is in lieu of any other warranty.
Warranty Duration. The Product is warranted to the original purchaser for a period of ninety (90) days from the original purchase. For purposes hereof, a person receiving the Product as a gift will be considered an original purchaser. Proof of purchase, including date of purchase, will be required to submit any warranty claim.
Warranty Coverage. THNK, LLC warrants that the Product is free from defects in material and workmanship when used for the intended purpose under normal conditions. THIS WARRANTY IS VOID IF THE PRODUCT HAS BEEN DAMAGED BY ACCIDENT, ALTERATION, MISUSE, NORMAL WEAR AND TEAR, NEGLIGENCE, IMPROPER SERVICE, FAILURE TO FOLLOW INSTRUCTIONS PROVIDED WITH THE PRODUCT OR OTHER CAUSES NOT ARISING OUT OF DEFECTS IN MATERIAL AND WORKMANSHIP.
Warranty Performance. During the ninety (90) day warranty period, THNK, LLC shall repair or replace with a comparable product or component thereof, if THNK, LLC has determined the Product to be defective and covered by this warranty. Other than costs for shipping (from the customer to THNK to be examined for defects in the workmanship or material), no charge shall be made for repair or replacement of products covered by this warranty.
Warranty Disclaimers. ANY IMPLIED WARRANTIES ARISING OUT OF THE SALE OF THE PRODUCT, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED EXCEPT TO THE EXTENT PROHIBITED BY LAW, IN WHICH CASE SUCH WARRANTY IS LIMITED TO THE DURATION OF THIS WRITTEN WARRANTY. THNK, LLC WILL NOT BE LIABLE FOR LOSS OF USE OF THE PRODUCT OR OTHER SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES. ALL LIABILITY IS LIMITED TO THE AMOUNT OF THE PURCHASE PRICE.
Some states and provinces do not allow the exclusion or limitation of implied warranties or special, consequential, or incidental damages, so the above limitations may not apply to you. If the disclaimers contained herein are held inapplicable by a court or tribunal of competent jurisdiction, any warranty will be deemed to be waived to the maximum extent allowed by applicable law.
Legal Remedies. This warranty gives you specific legal rights and you may also have other rights which may vary from state to state or from province to province. The warranties contained herein are limited to products sold and used in the United States and Canada.
